
When President Trump tweeted on March 4 that “all federal funding will STOP for any College, School, or University that allows illegal protests,” he puzzled many academics. Most protests are lawful and constitutionally protected. Even more bewildering, he emphasized “NO MASKS!” Since then, Education Secretary Linda McMahon has begun cutting off some funds. Is this mere bullying, or is it a response to a real legal problem?
One thing you will have noticed about the “protests” – read riots – conducted by Antifa in recent years and especially by pro-Hamas groups in America, was how often they were masked up, and in the case of the former, wearing black clothing that made them look almost identical.
They did this for the obvious reason of making it harder for their opponents and the Police to identify individuals for arrest and prosecution (for arrests Antifa also developed swarming tactics where they try and prise arrestees out of the grip of Police).
This is not a new tactic, it’s the same reason the KKK used their infamous masks and full body bedsheets as well, which is why the Ku Klux Klan Act was passed in the USA in 1871 specifically to deal with that issue, as Professor Hamburger (yes, really) goes on to explain:

One of its provisions is now Section 1985 of Title 42 of the U.S. Code. It provides for damages when two or more persons “conspire or go in disguise on the highway or on the premises of another, for the purpose of depriving, either directly or indirectly, any person or class of persons of the equal protection of the laws.” This statute recognizes masking as an equal-protection problem.

Like Klansmen, masked students shield themselves from accountability for disruption and violence. A university, not knowing their identities, can’t take disciplinary actions against them, including disciplinary actions required by Title VI.
Brilliant. There is nothing funnier than seeing Antifa and pro-Hamas thugs being caught up by the same laws that dealt with the Ku Klux Klan, especially given that the most recent targets have been Jews in American universities.
Admittedly the masking should not have stopped universities from dealing with this stuff earlier, if they can intervene in students’ love lives over Title IX they should be willing and capable of stopping masked violent thugs under Title VI.
The flip side of the coin is that the Left, fully understanding the power of anonymity, always work hard to “rip the masks off” their opponents so that they can be punished in various ways.
A recent example was the doxxing of one “Data Republican”, who has used various IT tools to take DOGE results and turn them into graphical layouts showing the waste, fraud and corruption of the State-Left grifting machine. This could not stand, and so:

However, as that article points out, she has received a massive outpouring of support from Republicans, including a reverse tracking process to identify the person who doxxed her, which is this is the piece of work who doxxed her (he’s a big fan of USAID, natch):
