From a post at Kiwiblog.
A Journalist with Chinese origins who fell victim to a bit of nonsensical legislation from the Key Years, Portia Mao has seen first hand what an errant State can manage. Portia was targeted using a poorly drafted law. The Harmful Digital Communications Act (HDCA), passed in 2015 ostensibly to mitigate internet harm to the vulnerable.
Of course with all such well intentioned and marketed legislative moves, the Law of Unintended consequences very quickly became a problem in crafty use of the Act adopting powers never intended and politicians both in office and wannabe pdq saw another little device to obstruct free speech and moves to bring sunlight to bear on truth.
To be clear, being punished under the HDCA is not the same thing as defamation. Rather, the HDCA is concerned with subjective claims of ‘harm’ – this means that truth is not a valid defence.
Who considers that a good thing?
Without apparently any reference by way of notice to Portia that she was under judicial attack from a person she had alerted to voters might be just a little tool empowered by CCP operatives.
These ultra crafty bastards using any and all methods to undermine our little naive tin pot Nation managed to get a “Judge” to take Portia down but she must be a feisty soul as she garnered support from freedom agents at the “free speech union” and gained a “win” in legally challenging the ruling.
I remember Portia from my ACT Party days. She’s about 4′ tall, but feisty. She’s a lot better than the other Mao.
